简介:交通事故的出现是因为产生险情与避让失败而发生,事故肇因是险情与避让的时空因素互动而形成.,本文介绍了中国台湾地区交通事故肇事因素分析的基本方法,即基于“交通险情”、“险情避让”以及“肇事原因”三者之间的因果关系,分析了险情因素中的人、车、路、景况等诸多因素,提出基于时、空、力等交通事故肇事原因分析的“三度五维”立体观分析方法,并提出“交通险情”、“险情避让”以及“肇事原因”三者之间存在复杂的因果关系,须严谨地探索及考证险情的多元性与避让的多变性,才能确定真正肇事因素并符合司法审判之法理精神“信赖原则”与“善尽原则”。
